HABENDUM CLAUSE The "to have and to hold" clause of a deed which defines or limits the estate granted. HEREDITAMENTS The largest and most inclusive classification of property. It includes real and personal property, tangible and intangible property rights, practically everything capable of being inherited. HIGHEST AND BEST USE An appraisal term referring to the most profitable use of land; That use or program of utilization which will produce the maximum net returns imputable to land over the total period comprising the future. HOMESTEAD The real estate occupied by the owner as his home. HYPOTHECATE To give a thing as security without the necessity of giving up possession of it. |
